There are rare cases where Judicial Recovery ("RJ") is the only way out. Many companies make the request, without wondering how this process will take place, without having an RJ plan.

Credibility with suppliers and financial institutions is the first one affected, with it, credit. Without credit, there is no working capital needed for purchases (cash), financing of sales and inventories.

Knowing the economic viability of the company and the plan it proposes, before the request of RJ, makes the decision conscious, since a plan rejected or not fulfilled, converts RJ into bankruptcy.

The judges, who seek to understand the viability of the company before granting the request have, increasingly adopted the Economic Expertise at the time of the request of RJ.

Most Restructuring Plans retain a dose of technique and reasonable consistency. Some overlook such important factors as working capital, credit unavailability and are inconsistent. But the problem of most of them is in the execution.

A good Restructuring Plan provides for execution in detail. Knowing what to do, which direction to follow is important. Knowing how to do it, who will be responsible, costs involved, capture curve of the values of each action and dates, have been shown to be more important.

We have adopted in the restructuring projects, project management structures (PMO), also used in investment projects, with weekly meetings and monitoring of performance indexes on targets, focusing on change management. The results are consistent.
